Terms of Service
1. Agreement to Terms
By accessing or using the Assumptions app, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the App. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization.
2. Description of the Service
Assumptions is a mobile application that helps you practice civil debate and constructive disagreement through AI-powered conversations. The Service includes:
- Debates with AI: Engage in structured debates with an AI partner on various topics, with adjustable difficulty levels (Easy, Medium, Hard) and scoring for civility, listening, and counterpoints.
- Challenges: Participate in structured debate challenges across three levels: Trivial, Town Hall, and National. Some challenge levels require a Premium subscription.
- AI Personalities: Debate with AI representations of historical figures, philosophers, leaders, activists, and innovators, each with unique perspectives and debate styles. This feature requires a Premium subscription.
- Today's News: Browse current news headlines and engage in debates about current events. This feature requires a Premium subscription.
- Custom Topics: Enter your own debate topics when using AI Personalities.
- Token System: The Service uses a token-based system for certain features. Free users receive 3 free debates per day, after which debates cost tokens. Premium subscribers receive unlimited standard debates and additional benefits.
- Premium Subscription: A paid subscription tier that provides unlimited standard debates, access to premium features (AI Personalities, Today's News, advanced Challenges), monthly token bonuses, and an ad-free experience. Subscription terms, pricing, and features are subject to change.
- Scoring and Statistics: Track your debate performance with metrics including civility scores, listening scores, counterpoints, and aggregated statistics.
We may add, change, or discontinue features over time. Features, pricing, and availability may vary by region.
3. Subscriptions and Payments
- Premium Subscription: The Service offers a Premium subscription tier that provides enhanced features, including unlimited standard debates, access to premium features (AI Personalities, Today's News, advanced Challenges), monthly token bonuses, and an ad-free experience. Subscriptions are billed through Google Play and are subject to Google Play's billing terms.
- Subscription Terms: Subscriptions automatically renew unless cancelled before the end of the current billing period. You can manage or cancel your subscription through your Google Play account settings. Cancellation takes effect at the end of the current billing period.
- Pricing: Subscription prices are displayed in the app and may vary by region. We reserve the right to change subscription prices with reasonable notice. Price changes will not affect your current subscription period but may apply to renewals.
- Refunds: Refund requests are handled according to Google Play's refund policy. We do not provide refunds except as required by law or Google Play's policies.
- Token Purchases: The Service may offer one-time purchases of token packs. Tokens are non-refundable and have no cash value. Token balances do not expire but may be reset or adjusted if we determine there has been fraudulent activity or abuse.
- Free Trials and Promotions: We may offer free trials or promotional pricing. Terms of such offers will be disclosed at the time of the offer. Free trials automatically convert to paid subscriptions unless cancelled before the trial period ends.
4. Account
- Registration: You may need to create an account (e.g., via Google sign-in) to use certain parts of the Service. You must provide accurate information and keep it current.
- Responsibility: You are responsible for all activity under your account and for keeping your credentials secure.
- Age: You must be at least 13 years old (or the age of digital consent in your jurisdiction, if higher) to use the Service. If you are under 18, you should have a parent or guardian’s permission.
- Suspension and termination: We may suspend or terminate your account if you breach these Terms, our Civil Discourse Guidelines, or for other reasons we deem necessary to protect the Service or other users.
5. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of applicable laws.
- Abuse, harass, bully, threaten, or harm others, or encourage such behavior.
- Use the Service to send spam, malware, or to interfere with the Service’s operation.
- Scrape, copy, or automate access to the Service in a way that bypasses normal use.
- Try to extract, reverse-engineer, or misuse our AI models, prompts, or systems (e.g., “jailbreaking” or prompt injection to evade safety or instructions).
- Impersonate others or create accounts that misrepresent your identity.
- Use the Service in any way that violates our Civil Discourse Guidelines.
We may take action (including warnings, limits, or account termination) if we determine you have violated these rules. We may cooperate with law enforcement where required.
6. User Content and Your License to Us
- Your content: You retain ownership of the content you submit (e.g., messages in debates, usernames). You are responsible for it.
- License to us: To operate the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, store, process, and transmit your content as needed to: provide the App (including sending your messages to our AI provider to generate responses), store conversation history and debate results, improve and secure the Service, and comply with law. This includes sharing with service providers (e.g., cloud hosting, AI) under obligations consistent with our Privacy Policy. We do not claim ownership of your content beyond this license.
7. Our Intellectual Property
The App, the name “Assumptions,” the “Banked Embers” brand, our logos, design, and any content we create are our (or our licensors’) intellectual property. You may not copy, modify, or use them without our written permission. Our trademarks and trade dress may not be used in a way that suggests endorsement or that misleads others.
8. Disclaimers
- “As is.” The Service is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- Not professional advice. The App is for practice and reflection only. It does not provide legal, medical, therapeutic, or other professional advice. Do not rely on it for decisions that require licensed expertise.
- AI and debate outcomes. Our AI is for practice and engagement. We do not guarantee the quality, accuracy, or suitability of AI-generated content or debate outcomes. Your use of the AI is at your own risk.
9. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service or these Terms.
- Our total liability for any claims arising from or related to the Service or these Terms is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) $100.
Some jurisdictions do not allow these limitations; in such cases, they apply only to the extent allowed.
10. Indemnity
You agree to indemnify and hold harmless Keller Tech LLC, Banked Embers, and our officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Service, (b) your content, or (c) your violation of these Terms or of any third party’s rights.
11. Changes to the Terms
We may update these Terms from time to time. We will notify you of material changes by posting the new Terms in the App and/or by email or in-app notice. The “Last updated” date at the top will change. Your continued use after the change constitutes acceptance. If you do not agree, you must stop using the Service. For material changes, we may require you to accept the new Terms before continued use.
12. Termination
- By you: You may stop using the Service at any time. You may delete your account in Settings.
- By us: We may suspend or terminate your access or account at any time, with or without notice, for any reason (including breach of these Terms or our Guidelines).
- Effect: On termination, your right to use the Service ends. Sections that by their nature should survive (including 5–9, 12) will survive.
13. General
- Governing law: These Terms are governed by the laws of the State of Mississippi and the United States, without regard to conflict-of-law principles.
- Disputes: Any dispute will be resolved in the state or federal courts in Mississippi. You consent to personal jurisdiction there.
- Entire agreement: These Terms, together with our Privacy Policy and Civil Discourse Guidelines, are the entire agreement between you and us regarding the Service.
- Severability: If any part of these Terms is held invalid, the rest remains in effect.
- Waiver: Our failure to enforce any right does not waive that right.
- Assignment: You may not assign these Terms. We may assign them in connection with a merger, sale, or reorganization.
